DOMESTIC VIOLENCE OFFENDER SENTENCED TO 7 YEARS, 4 MONTHS STATE PRISON

Defendant Cesar Alfaro Garibay, 39 years old of Santa Rosa, was sentenced yesterday by the Honorable Robert LaForge to serve 7 years and 4 months in state prison after he admitted a violation of probation for a prior residential burglary from 2022, a new felony vandalism offense, and a violation of a domestic violence criminal protective order. In addition, the defendant admitted a prior “strike” sentencing enhancement based on the burglary conviction.

On July 14, 2022, Garibay was convicted of first-degree burglary, domestic battery and resisting arrest resulting from an incident where he broke into the residence of his domestic partner, pulled her hair, and stole her cell phone. At the time, he admitted doing so because he believed she was talking to another man. He was placed on a 3-year grant of probation and ordered to complete domestic violence treatment and a no-contact criminal protective order was issued, ordering him to have no contact with the victim for 3 years.

On October 29, 2022, while on probation in the above-referenced-matter, defendant showed up to the same victim’s residence, in violation of a pending restraining order, and broke her front window. Defendant was convicted of violating the protective order (while using violence,) and admitted an enhancement for having a separate sustained prior conviction of violating a protective order.

Since 2019, defendant has been convicted of nine separate violations of violating a protective order involving the same victim. Defendant was sentenced to the maximum term of confinement for his admitted offenses.

The case was investigated by the Sonoma County Sheriff’s Department and handled by Deputy District Attorney Jessalee Mills.
