Sex Offender Receives 9 Years in Prison for Annoying/Molesting a Child

Defendant Kyle Thomas Uboldi, 49-years-old of Santa Rosa, was sentenced today to 9 years in state prison by the Honorable Dana Simonds after having pled “no contest” in April to one felony count of annoying or molesting a child. At the time of his plea the defendant also admitted a “strike” based on a prior conviction for committing a lewd or lascivious act upon a child under the age of fourteen. He also admitted a sentencing enhancement for having served time in prison within the past five years.

The Santa Rosa Police Department investigation which produced the charges showed that in August of 2017, Uboldi followed a 10 year-old girl into the bathroom in a common area at the girl’s apartment building. The child’s 12 year-old sister thought it was odd when she saw Uboldi follow her sister to the bathroom, so she went to go check on her. When the 12 year-old approached the bathroom where her sister was alone in a stall she saw the man on the women’s bathroom floor, crouched down on his hands and knees. The man fled before law enforcement could arrive. However, the terms of Uboldi’s parole required him to wear a GPS ankle bracelet which placed him at the scene.

At the time of the instant offense Uboldi was being supervised on parole following a conviction and prison sentence for annoying or molesting a child, a crime he committed in 2012 when he was found at a store in Sonoma County with his cell phone extended underneath a dressing room door where a 15-year-old girl was trying on skirts.

Due to recent changes in California sentencing laws, it’s expected that Uboldi will be eligible for parole consideration after serving four years of his sentence.

This case was prosecuted by Deputy District Attorney Andrew Lukas. Detective Rick Boehm and Officer Eugene May of the Santa Rosa Police Department headed the investigation. Parole Agent Jeff Gill also assisted in the investigation.
