Raley’s Pays $400,000 to Settle California Unfair Competition Lawsuit for Sale of Expired Over the Counter Medications

SANTA ROSA,CA | April 30, 2025

District Attorney Carla Rodriguez announced today that the Sonoma County District Attorney’s Office, in collaboration with the District Attorney offices of Yolo County, Sacramento County, Shasta County and San Joaquin County, has reached a settlement with Raley’s supermarkets regarding the sale and offer for sale of expired over the counter (OTC) drugs. The judgment was entered by the Honorable Timothy Fall, in Yolo County Superior Court, on April 21, 2025.

The case stems from an unfair business practice investigation, which revealed that Raley’s offered expired OTC drug products for sale in violation of a prior injunction addressing similar business activities. The investigation identified categories of OTC drugs not accounted-for in Raley’s compliance program, leading to this enforcement action. Raley’s cooperated with the investigation and promptly addressed the issues.

Under the terms of the settlement, Raley’s will pay $278,000 in civil penalties and $111,000 in cost recovery. Additionally, Raley’s will contribute $5,000 to the Redwood Empire Food Bank through the Food for Families program. These funds will be used to purchase baby food, infant formula, and related products for distribution to families in need within Sonoma County.

“Ensuring consumers receive the full benefit of the goods they purchase and that businesses comply with fair business practices is a priority for my office,” said Sonoma County District Attorney Carla Rodriguez. “This settlement holds Raley’s accountable and provides meaningful support to our community through the Redwood Empire Food Bank Program.”
