Yeti Coolers, LLC Settles Violations Related to Delayed Shipping in California

SANTA ROSA, CA | July 14, 2023

On July 11, 2023, Judge Brad DeMeo entered a Stipulated Judgement against Yeti Coolers LLC (“Yeti”) in the amount of $40,490 in Civil Case No SCV-273598. This Judgment settles allegations that Yeti misrepresented that customers would receive delivery of certain products by a specified date related to holiday promotions. The case was brought by the consumer protection units of the Sonoma, Napa, and Alameda County District Attorney’s Offices.

Yeti advertised that if consumers ordered products for holidays such as Mother’s Day or Father’s Day by a designated time that the product would be received prior to said holiday. Complaints were received that the deliveries did not occur as represented. Yeti cooperated promptly with the investigation and quickly identified and corrected the issue. Yeti issued some refunds to consumers and provided discount coupons to other consumers prior to being contacted by the District Attorney’s Offices.

District Attorney Carla Rodriguez stated: “Our Environmental and Consumer Law Division is dedicated to making sure that consumers receive products or services as advertised and that companies accurately represent those goods and services in accordance with California Law.”

As part of the judgment, Yeti was required to pay $40,490 in civil penalties, costs, and cy pres restitution. The Judgment includes a permanent statewide injunction, requiring Yeti to make clear and conspicuous to consumers any disclaimers related to delivery dates, and to not represent that products will be delivered by a specific date unless it has undertaken good faith steps to ensure the product will be delivered in such timeframe. Finally, Yeti was ordered to comply with Business & Professions Code section 17538(a), which requires companies to take certain steps if a mail order product cannot be shipped within thirty (30) days of the date ordered.
